Termini e Condizioni d'Uso del Bot Telegram YuppieX

1. Titolare del servizio

Il bot Telegram YuppieX (di seguito il "Bot") è gestito da:

Il Bot è parte integrante dei servizi della piattaforma Yuppiex e si affianca, senza sostituirli, all'area riservata e agli altri canali di comunicazione ufficiali.

2. Oggetto e natura del servizio

Il Bot è un servizio accessorio e gratuito di notifica, riservato agli utenti registrati sulla piattaforma Yuppiex, che invia sul canale Telegram dell'utente informazioni relative esclusivamente al proprio account.

Il Bot:

  • non fornisce servizi finanziari, di investimento o di intermediazione;
  • non presta consulenza finanziaria, fiscale o legale;
  • non esegue ordini, operazioni, pagamenti, prelievi o modifiche di alcun tipo;
  • non gestisce fondi, capitali o strumenti finanziari;
  • non costituisce raccomandazione, segnale operativo, sollecitazione o promessa di risultato.

Coerentemente con la natura della piattaforma Yuppiex descritta alla Sezione 2 dei Termini e Condizioni generali, tutte le informazioni veicolate dal Bot hanno finalità esclusivamente informativa, educativa, tecnica o simulativa. In particolare, i riferimenti a challenge, simulazioni, fasi ed esiti riguardano ambienti simulativi e non performance su mercati regolamentati.

3. Rapporto con gli altri documenti contrattuali

L'uso del Bot comporta l'accettazione integrale dei presenti Termini e, per quanto non espressamente derogato, dei seguenti documenti, che restano pienamente applicabili:

In caso di contrasto fra i presenti Termini e i Termini e Condizioni generali, questi ultimi prevalgono, salvo che i presenti Termini disciplinino in modo più specifico il funzionamento del Bot.

L'uso del Bot è inoltre soggetto ai termini di servizio e alle policy di Telegram, applicazione di messaggistica gestita da soggetti terzi rispetto a YUPPIES FZCO.

4. Requisiti e ammissibilità

Per utilizzare il Bot l'utente dichiara e garantisce di:

  1. essere titolare di un account attivo e regolarmente registrato sulla piattaforma Yuppiex;
  2. avere almeno 18 anni e la capacità giuridica necessaria;
  3. essere l'effettivo titolare dell'account Telegram utilizzato per il collegamento;
  4. non collegare al proprio account Yuppiex dispositivi o account Telegram di terzi.

Il servizio non è destinato a soggetti diversi dai clienti registrati e non è accessibile in forma anonima.

5. Attivazione e collegamento dell'account

Il collegamento avviene esclusivamente tramite un link personale monouso generato dall'utente all'interno della propria area riservata su app.yuppiex.com.

  1. Il link ha validità limitata nel tempo ed è utilizzabile una sola volta.
  2. La generazione di un nuovo link invalida il precedente.
  3. Il link è personale: la sua condivisione, volontaria o accidentale, consente a terzi di ricevere le informazioni relative all'account dell'utente. L'utente è responsabile della sua custodia, così come lo è delle proprie credenziali ai sensi della Sezione 5 dei Termini e Condizioni generali.
  4. L'utente può collegare un numero limitato di dispositivi, indicato al momento del collegamento.

L'attivazione del Bot è volontaria e facoltativa: la mancata attivazione non limita in alcun modo l'accesso alla piattaforma né ai servizi sottoscritti.

6. Contenuto delle notifiche

Il Bot può inviare notifiche relative ai seguenti eventi, tutti riferiti al solo account dell'utente destinatario:

  • esito delle simulazioni e delle challenge (qualificazione o mancata qualificazione);
  • approssimarsi della scadenza dell'abbonamento o della membership;
  • prelievi elaborati;
  • accrediti di commissioni e altri importi a favore dell'utente;
  • comunicazioni tecniche relative al funzionamento del Bot stesso.

Il Bot non mostra e non invia: dati personali o economici di altri utenti, informazioni sulla rete di referral o sulla struttura, classifiche, credenziali di accesso, password di conti presso soggetti terzi, documenti o dati di pagamento.

L'utente può disattivare singole categorie di notifica o l'intero servizio in qualsiasi momento tramite i comandi messi a disposizione dal Bot.

7. Valore informativo delle notifiche

Le notifiche inviate dal Bot hanno valore esclusivamente informativo e di cortesia.

  1. Fa fede l'area riservata. In caso di discrepanza fra il contenuto di una notifica e quanto risulta nell'area riservata dell'utente o nei sistemi della Società, prevale quest'ultimo.
  2. La consegna non è garantita. Il recapito dipende da Telegram, dalla connettività e dal dispositivo dell'utente. La Società non garantisce che le notifiche siano consegnate, che lo siano in tempo utile o che siano visualizzate.
  3. Nessun effetto liberatorio. La mancata, tardiva o errata ricezione di una notifica non costituisce giustificazione per il mancato rispetto di scadenze, adempimenti o condizioni contrattuali, né fonda alcun diritto al risarcimento. È onere dell'utente verificare la propria posizione nell'area riservata.
  4. Le notifiche non costituiscono comunicazione contrattuale formale né sostituiscono le comunicazioni inviate agli altri recapiti indicati dall'utente.

8. Dati personali

Il trattamento dei dati personali connesso al Bot avviene nel rispetto della Privacy Policy YuppieX e della normativa applicabile, incluso il Regolamento (UE) 2016/679 (GDPR) ove applicabile e il UAE Federal Decree Law No. 45 of 2021 (PDPL) ove applicabile.

Dati trattati in relazione al Bot

Identificativo della chat Telegram, nome utente Telegram ove disponibile, lingua preferita, data e stato del collegamento, preferenze di notifica, registro tecnico degli invii (tipo di evento ed esito).

Finalità

Erogazione del servizio di notifica richiesto dall'utente, sicurezza del servizio, prevenzione di abusi.

Base giuridica

Consenso dell'utente, manifestato con l'attivazione volontaria del collegamento, revocabile in qualsiasi momento senza conseguenze sugli altri servizi; nonché legittimo interesse della Società alla sicurezza del servizio.

Comunicazione a terzi

L'invio delle notifiche comporta necessariamente il transito dei relativi contenuti attraverso l'infrastruttura di Telegram, soggetto terzo e autonomo rispetto alla Società, con proprie condizioni e proprie informative privacy, che l'utente è invitato a consultare. La Società non controlla le modalità di conservazione e trattamento adottate da Telegram.

Trasferimenti internazionali

I dati possono essere trattati in Paesi diversi da quello dell'utente, inclusi gli Emirati Arabi Uniti e Paesi dell'Unione Europea, secondo quanto previsto dalla Privacy Policy.

Conservazione

I dati relativi al collegamento sono conservati finché il collegamento resta attivo e, successivamente, per il tempo necessario ad adempimenti di legge, di sicurezza e di prevenzione degli abusi. Lo scollegamento comporta la cessazione degli invii e la cancellazione o anonimizzazione dei dati di collegamento non più necessari.

Diritti dell'utente

Accesso, rettifica, cancellazione, limitazione, opposizione, portabilità e revoca del consenso, esercitabili scrivendo a info@yuppiex.com.

Avvertenza. Le notifiche contengono informazioni relative al proprio account e vengono visualizzate sul dispositivo dell'utente, anche in forma di anteprima a schermo bloccato. L'utente è invitato a valutare tale circostanza e a proteggere adeguatamente il proprio dispositivo e il proprio account Telegram.

9. Sicurezza e avvertenza anti-frode

Il Bot non chiede mai: password, codici di accesso, codici a due fattori, dati di carte di pagamento, trasferimenti di denaro, né l'installazione di software.

Qualunque messaggio che richieda tali elementi, anche se apparentemente proveniente da YuppieX o da un profilo che ne imita nome e immagine, non proviene dalla Società e va segnalato a support@yuppiex.com senza dare seguito.

La Società non risponde delle conseguenze derivanti da comunicazioni intercorse con bot, canali, gruppi o profili Telegram non ufficiali.

L'utente è tenuto a comunicare tempestivamente alla Società la perdita di controllo del proprio account Telegram o del dispositivo collegato, affinché il collegamento possa essere revocato.

10. Uso consentito e divieti

È vietato:

  • utilizzare il Bot per finalità illecite o in violazione della normativa applicabile;
  • tentare di accedere a dati relativi ad altri utenti;
  • aggirare, sondare o compromettere i meccanismi di collegamento, autenticazione o limitazione del servizio;
  • automatizzare, replicare, rivendere o ridistribuire il servizio o i suoi contenuti;
  • presentare il Bot, o i contenuti che veicola, come servizio finanziario, segnale operativo o consulenza;
  • utilizzare marchi, logo, nome o grafica del Bot per creare canali, gruppi o bot che possano essere confusi con quelli ufficiali.

La Società può sospendere o revocare immediatamente il collegamento in caso di violazione, di sospetto abuso o di rischio per la sicurezza, ai sensi della Sezione 16 dei Termini e Condizioni generali.

11. Disponibilità del servizio

Il Bot è fornito "così com'è", senza garanzie di continuità, disponibilità o assenza di errori. La Società può, in qualsiasi momento e senza preavviso, modificare, sospendere o cessare il servizio, in tutto o in parte, anche per esigenze tecniche, di sicurezza o di conformità normativa, senza che ciò dia diritto a indennizzi.

Il funzionamento del Bot dipende da Telegram: interruzioni, limitazioni, blocchi o modifiche introdotte da Telegram, o l'indisponibilità del servizio nel Paese dell'utente, non sono imputabili alla Società.

12. Limitazione di responsabilità

Nei limiti consentiti dalla legge applicabile, e in coerenza con la Sezione 12 dei Termini e Condizioni generali, YUPPIES FZCO non risponde di:

  • mancata, tardiva, duplicata o errata ricezione delle notifiche;
  • decisioni assunte dall'utente sulla base del contenuto di una notifica;
  • accessi non autorizzati al dispositivo o all'account Telegram dell'utente;
  • condivisione, volontaria o accidentale, del link personale di collegamento;
  • malfunzionamenti, interruzioni o restrizioni imputabili a Telegram o ad altri soggetti terzi;
  • perdita di dati o di messaggi determinata da fattori esterni al controllo della Società.

Trattandosi di servizio accessorio e gratuito, nessuna responsabilità della Società può derivare dal solo mancato funzionamento del Bot, fermi restando i diritti inderogabili riconosciuti all'utente consumatore dalla normativa applicabile.

13. Disattivazione

L'utente può interrompere il servizio in qualsiasi momento:

  • con il comando /stop all'interno del Bot;
  • dalla sezione dedicata della propria area riservata;
  • bloccando il Bot su Telegram.

La disattivazione ha effetto immediato sui nuovi invii, comporta la revoca del consenso di cui alla Sezione 8 e non produce alcun effetto sull'account Yuppiex, sull'abbonamento o sugli altri servizi sottoscritti.

14. Modifiche ai presenti Termini

La Società può modificare i presenti Termini in qualsiasi momento. Le modifiche entrano in vigore dalla pubblicazione su yuppiex.com. Le modifiche sostanziali saranno segnalate tramite il Bot stesso o gli altri canali di contatto. L'uso continuato del Bot successivo alla pubblicazione costituisce accettazione delle modifiche; in mancanza di accettazione, l'utente può disattivare il servizio ai sensi della Sezione 13.

15. Legge applicabile e foro competente

I presenti Termini sono disciplinati e interpretati in conformità alle leggi applicabili negli Emirati Arabi Uniti, fatti salvi i diritti inderogabili riconosciuti agli utenti consumatori dalla normativa del loro Paese di residenza.

Qualsiasi controversia derivante da o connessa ai presenti Termini o all'utilizzo del Bot sarà devoluta alla competenza esclusiva dei tribunali di Dubai, Emirati Arabi Uniti, salvo diversa previsione inderogabile di legge.

16. Clausole specificamente approvate

L'utente dichiara di approvare espressamente le seguenti clausole: Sezione 7 (Valore informativo delle notifiche), Sezione 11 (Disponibilità del servizio), Sezione 12 (Limitazione di responsabilità), Sezione 15 (Legge applicabile e foro competente).

1. Anbieter des Dienstes

Der YuppieX Telegram-Bot (nachfolgend der „Bot“) wird betrieben von:

Der Bot ist Bestandteil der Dienste der Yuppiex-Plattform und ergänzt den persönlichen Bereich sowie die übrigen offiziellen Kommunikationskanäle, ohne sie zu ersetzen.

2. Gegenstand und Art des Dienstes

Der Bot ist ein ergänzender, kostenloser Benachrichtigungsdienst für auf der Yuppiex-Plattform registrierte Nutzer, der über den Telegram-Kanal des Nutzers Informationen sendet, die sich ausschließlich auf dessen eigenes Konto beziehen.

Der Bot:

  • erbringt keine Finanz-, Anlage- oder Vermittlungsdienstleistungen;
  • leistet keine Finanz-, Steuer- oder Rechtsberatung;
  • führt keine Aufträge, Transaktionen, Zahlungen, Auszahlungen oder Änderungen irgendeiner Art aus;
  • verwaltet keine Gelder, Kapitalien oder Finanzinstrumente;
  • stellt keine Empfehlung, kein Handelssignal, keine Aufforderung und kein Ergebnisversprechen dar.

Entsprechend der in Abschnitt 2 der Allgemeinen Geschäftsbedingungen beschriebenen Natur der Yuppiex-Plattform dienen alle über den Bot übermittelten Informationen ausschließlich informativen, edukativen, technischen oder simulativen Zwecken. Insbesondere beziehen sich Hinweise auf Challenges, Simulationen, Phasen und Ergebnisse auf simulierte Umgebungen und nicht auf Leistungen an regulierten Märkten.

3. Verhältnis zu den übrigen Vertragsdokumenten

Die Nutzung des Bots setzt die vollständige Annahme dieser Bedingungen sowie – soweit hier nicht ausdrücklich abweichend geregelt – der folgenden, weiterhin uneingeschränkt geltenden Dokumente voraus:

Bei Widersprüchen zwischen diesen Bedingungen und den Allgemeinen Geschäftsbedingungen gehen Letztere vor, es sei denn, diese Bedingungen regeln die Funktionsweise des Bots spezifischer.

Die Nutzung des Bots unterliegt zudem den Nutzungsbedingungen und Richtlinien von Telegram, einer von Dritten – unabhängig von YUPPIES FZCO – betriebenen Messaging-Anwendung.

4. Voraussetzungen und Zugangsberechtigung

Mit der Nutzung des Bots erklärt und gewährleistet der Nutzer:

  1. Inhaber eines aktiven, ordnungsgemäß auf der Yuppiex-Plattform registrierten Kontos zu sein;
  2. mindestens 18 Jahre alt und geschäftsfähig zu sein;
  3. tatsächlicher Inhaber des für die Verknüpfung verwendeten Telegram-Kontos zu sein;
  4. keine Geräte oder Telegram-Konten Dritter mit dem eigenen Yuppiex-Konto zu verknüpfen.

Der Dienst richtet sich ausschließlich an registrierte Kunden und ist nicht anonym zugänglich.

5. Aktivierung und Verknüpfung des Kontos

Die Verknüpfung erfolgt ausschließlich über einen persönlichen Einmal-Link, den der Nutzer in seinem persönlichen Bereich auf app.yuppiex.com erzeugt.

  1. Der Link ist zeitlich begrenzt gültig und nur einmal verwendbar.
  2. Die Erzeugung eines neuen Links macht den vorherigen ungültig.
  3. Der Link ist persönlich: Seine – freiwillige oder versehentliche – Weitergabe ermöglicht Dritten den Empfang der Informationen zum Konto des Nutzers. Der Nutzer ist für seine Verwahrung ebenso verantwortlich wie für seine Zugangsdaten gemäß Abschnitt 5 der Allgemeinen Geschäftsbedingungen.
  4. Der Nutzer kann eine begrenzte, bei der Verknüpfung angegebene Anzahl von Geräten verknüpfen.

Die Aktivierung des Bots ist freiwillig und optional: Die Nichtaktivierung schränkt den Zugang zur Plattform oder zu den abonnierten Diensten in keiner Weise ein.

6. Inhalt der Benachrichtigungen

Der Bot kann Benachrichtigungen zu den folgenden Ereignissen senden, die sich alle ausschließlich auf das Konto des empfangenden Nutzers beziehen:

  • Ergebnis von Simulationen und Challenges (Qualifikation oder Nichtqualifikation);
  • bevorstehender Ablauf des Abonnements oder der Mitgliedschaft;
  • bearbeitete Auszahlungen;
  • Gutschriften von Provisionen und sonstigen Beträgen zugunsten des Nutzers;
  • technische Mitteilungen zum Betrieb des Bots selbst.

Der Bot zeigt und sendet nicht: personenbezogene oder wirtschaftliche Daten anderer Nutzer, Informationen zum Empfehlungsnetzwerk oder zur Struktur, Ranglisten, Zugangsdaten, Passwörter von Konten bei Dritten, Dokumente oder Zahlungsdaten.

Der Nutzer kann einzelne Benachrichtigungskategorien oder den gesamten Dienst jederzeit über die vom Bot bereitgestellten Befehle deaktivieren.

7. Informativer Charakter der Benachrichtigungen

Die vom Bot gesendeten Benachrichtigungen haben ausschließlich informativen Charakter und erfolgen aus Kulanz.

  1. Maßgeblich ist der persönliche Bereich. Bei Abweichungen zwischen dem Inhalt einer Benachrichtigung und den Angaben im persönlichen Bereich des Nutzers oder in den Systemen der Gesellschaft gelten Letztere.
  2. Die Zustellung wird nicht garantiert. Der Empfang hängt von Telegram, der Konnektivität und dem Gerät des Nutzers ab. Die Gesellschaft garantiert nicht, dass Benachrichtigungen zugestellt, rechtzeitig zugestellt oder angezeigt werden.
  3. Keine befreiende Wirkung. Der ausbleibende, verspätete oder fehlerhafte Empfang einer Benachrichtigung rechtfertigt weder die Nichteinhaltung von Fristen, Pflichten oder Vertragsbedingungen noch begründet er einen Anspruch auf Schadensersatz. Es obliegt dem Nutzer, seinen Status im persönlichen Bereich zu prüfen.
  4. Benachrichtigungen stellen keine förmliche Vertragskommunikation dar und ersetzen nicht die Mitteilungen an die übrigen vom Nutzer angegebenen Kontaktadressen.

8. Personenbezogene Daten

Die mit dem Bot verbundene Verarbeitung personenbezogener Daten erfolgt gemäß der YuppieX-Datenschutzerklärung und dem anwendbaren Recht, einschließlich der Verordnung (EU) 2016/679 (DSGVO), soweit anwendbar, und des UAE Federal Decree Law No. 45 of 2021 (PDPL), soweit anwendbar.

Im Zusammenhang mit dem Bot verarbeitete Daten

Kennung des Telegram-Chats, Telegram-Benutzername (sofern vorhanden), bevorzugte Sprache, Datum und Status der Verknüpfung, Benachrichtigungseinstellungen, technisches Versandprotokoll (Ereignistyp und Ergebnis).

Zwecke

Erbringung des vom Nutzer angeforderten Benachrichtigungsdienstes, Sicherheit des Dienstes, Missbrauchsprävention.

Rechtsgrundlage

Einwilligung des Nutzers, erteilt durch die freiwillige Aktivierung der Verknüpfung und jederzeit ohne Auswirkungen auf die übrigen Dienste widerrufbar; sowie berechtigtes Interesse der Gesellschaft an der Sicherheit des Dienstes.

Weitergabe an Dritte

Der Versand der Benachrichtigungen bedingt zwangsläufig die Übermittlung der Inhalte über die Infrastruktur von Telegram, einem von der Gesellschaft unabhängigen Dritten mit eigenen Bedingungen und Datenschutzhinweisen, die der Nutzer einzusehen gebeten wird. Die Gesellschaft hat keine Kontrolle über die Speicher- und Verarbeitungsmethoden von Telegram.

Internationale Datenübermittlungen

Die Daten können in anderen Ländern als dem des Nutzers verarbeitet werden, einschließlich der Vereinigten Arabischen Emirate und Länder der Europäischen Union, gemäß der Datenschutzerklärung.

Speicherdauer

Die Verknüpfungsdaten werden gespeichert, solange die Verknüpfung aktiv ist, und anschließend für die zur Erfüllung gesetzlicher Pflichten, zur Sicherheit und zur Missbrauchsprävention erforderliche Dauer. Die Trennung führt zur Einstellung des Versands und zur Löschung oder Anonymisierung nicht mehr benötigter Verknüpfungsdaten.

Rechte des Nutzers

Auskunft, Berichtigung, Löschung, Einschränkung, Widerspruch, Datenübertragbarkeit und Widerruf der Einwilligung, ausübbar per E-Mail an info@yuppiex.com.

Hinweis. Die Benachrichtigungen enthalten Informationen zum eigenen Konto und werden auf dem Gerät des Nutzers angezeigt, auch als Vorschau auf dem Sperrbildschirm. Der Nutzer wird gebeten, dies zu berücksichtigen und sein Gerät sowie sein Telegram-Konto angemessen zu schützen.

9. Sicherheit und Betrugswarnung

Der Bot fragt niemals nach: Passwörtern, Zugangscodes, Zwei-Faktor-Codes, Zahlungskartendaten, Geldüberweisungen oder der Installation von Software.

Jede Nachricht, die solche Elemente verlangt – auch wenn sie scheinbar von YuppieX oder von einem Profil stammt, das dessen Namen und Bild nachahmt – stammt nicht von der Gesellschaft und ist ohne Reaktion an support@yuppiex.com zu melden.

Die Gesellschaft haftet nicht für Folgen aus der Kommunikation mit inoffiziellen Telegram-Bots, -Kanälen, -Gruppen oder -Profilen.

Der Nutzer ist verpflichtet, der Gesellschaft den Kontrollverlust über sein Telegram-Konto oder das verknüpfte Gerät unverzüglich mitzuteilen, damit die Verknüpfung widerrufen werden kann.

10. Zulässige Nutzung und Verbote

Untersagt ist:

  • die Nutzung des Bots zu rechtswidrigen Zwecken oder unter Verstoß gegen geltendes Recht;
  • der Versuch, auf Daten anderer Nutzer zuzugreifen;
  • das Umgehen, Ausspähen oder Kompromittieren der Verknüpfungs-, Authentifizierungs- oder Begrenzungsmechanismen des Dienstes;
  • das Automatisieren, Vervielfältigen, Weiterverkaufen oder Weiterverbreiten des Dienstes oder seiner Inhalte;
  • die Darstellung des Bots oder der von ihm übermittelten Inhalte als Finanzdienstleistung, Handelssignal oder Beratung;
  • die Verwendung von Marken, Logos, Namen oder Grafiken des Bots zur Erstellung von Kanälen, Gruppen oder Bots, die mit den offiziellen verwechselt werden könnten.

Die Gesellschaft kann die Verknüpfung bei Verstößen, Missbrauchsverdacht oder Sicherheitsrisiken gemäß Abschnitt 16 der Allgemeinen Geschäftsbedingungen sofort aussetzen oder widerrufen.

11. Verfügbarkeit des Dienstes

Der Bot wird „wie besehen“ bereitgestellt, ohne Gewähr für Kontinuität, Verfügbarkeit oder Fehlerfreiheit. Die Gesellschaft kann den Dienst jederzeit und ohne Vorankündigung ganz oder teilweise ändern, aussetzen oder einstellen, auch aus technischen, sicherheitsbezogenen oder regulatorischen Gründen, ohne dass hieraus ein Anspruch auf Entschädigung entsteht.

Der Betrieb des Bots hängt von Telegram ab: Unterbrechungen, Einschränkungen, Sperrungen oder Änderungen durch Telegram oder die Nichtverfügbarkeit des Dienstes im Land des Nutzers sind der Gesellschaft nicht zurechenbar.

12. Haftungsbeschränkung

Im gesetzlich zulässigen Umfang und im Einklang mit Abschnitt 12 der Allgemeinen Geschäftsbedingungen haftet YUPPIES FZCO nicht für:

  • ausbleibenden, verspäteten, doppelten oder fehlerhaften Empfang von Benachrichtigungen;
  • Entscheidungen des Nutzers auf Grundlage des Inhalts einer Benachrichtigung;
  • unbefugten Zugriff auf das Gerät oder das Telegram-Konto des Nutzers;
  • die – freiwillige oder versehentliche – Weitergabe des persönlichen Verknüpfungslinks;
  • Störungen, Unterbrechungen oder Einschränkungen, die Telegram oder anderen Dritten zuzurechnen sind;
  • Verlust von Daten oder Nachrichten durch Faktoren außerhalb der Kontrolle der Gesellschaft.

Da es sich um einen ergänzenden und kostenlosen Dienst handelt, kann aus dem bloßen Nichtfunktionieren des Bots keine Haftung der Gesellschaft entstehen; unberührt bleiben die dem Verbraucher nach anwendbarem Recht zwingend zustehenden Rechte.

13. Deaktivierung

Der Nutzer kann den Dienst jederzeit beenden:

  • mit dem Befehl /stop im Bot;
  • über den entsprechenden Bereich seines persönlichen Bereichs;
  • durch Blockieren des Bots in Telegram.

Die Deaktivierung wirkt sofort auf neue Sendungen, bedeutet den Widerruf der Einwilligung gemäß Abschnitt 8 und hat keine Auswirkungen auf das Yuppiex-Konto, das Abonnement oder die übrigen abonnierten Dienste.

14. Änderungen dieser Bedingungen

Die Gesellschaft kann diese Bedingungen jederzeit ändern. Änderungen treten mit der Veröffentlichung auf yuppiex.com in Kraft. Wesentliche Änderungen werden über den Bot selbst oder die übrigen Kontaktkanäle mitgeteilt. Die fortgesetzte Nutzung des Bots nach der Veröffentlichung gilt als Annahme der Änderungen; andernfalls kann der Nutzer den Dienst gemäß Abschnitt 13 deaktivieren.

15. Anwendbares Recht und Gerichtsstand

Diese Bedingungen unterliegen dem in den Vereinigten Arabischen Emiraten geltenden Recht und sind nach diesem auszulegen; unberührt bleiben die zwingenden Rechte, die Verbrauchern nach dem Recht ihres Wohnsitzlandes zustehen.

Für alle Streitigkeiten aus oder im Zusammenhang mit diesen Bedingungen oder der Nutzung des Bots sind ausschließlich die Gerichte von Dubai, Vereinigte Arabische Emirate, zuständig, soweit nicht zwingendes Recht etwas anderes vorsieht.

16. Ausdrücklich genehmigte Klauseln

Der Nutzer erklärt, die folgenden Klauseln ausdrücklich zu genehmigen: Abschnitt 7 (Informativer Charakter der Benachrichtigungen), Abschnitt 11 (Verfügbarkeit des Dienstes), Abschnitt 12 (Haftungsbeschränkung), Abschnitt 15 (Anwendbares Recht und Gerichtsstand).

1. Service provider

The YuppieX Telegram bot (hereinafter the "Bot") is operated by:

The Bot is an integral part of the Yuppiex platform services and complements, without replacing, the user's account area and the other official communication channels.

2. Subject and nature of the service

The Bot is a free, ancillary notification service, reserved for users registered on the Yuppiex platform, which sends to the user's Telegram channel information relating exclusively to their own account.

The Bot:

  • does not provide financial, investment or brokerage services;
  • does not provide financial, tax or legal advice;
  • does not execute orders, transactions, payments, withdrawals or changes of any kind;
  • does not manage funds, capital or financial instruments;
  • does not constitute a recommendation, trading signal, solicitation or promise of results.

Consistently with the nature of the Yuppiex platform described in Section 2 of the general Terms and Conditions, all information conveyed by the Bot is for informational, educational, technical or simulation purposes only. In particular, references to challenges, simulations, phases and outcomes relate to simulated environments and not to performance on regulated markets.

3. Relationship with the other contractual documents

Use of the Bot implies full acceptance of these Terms and, except where expressly derogated, of the following documents, which remain fully applicable:

In the event of conflict between these Terms and the general Terms and Conditions, the latter prevail, unless these Terms govern the operation of the Bot more specifically.

Use of the Bot is also subject to the terms of service and policies of Telegram, a messaging application operated by third parties independent of YUPPIES FZCO.

4. Requirements and eligibility

To use the Bot the user declares and warrants that they:

  1. hold an active account duly registered on the Yuppiex platform;
  2. are at least 18 years old and have the necessary legal capacity;
  3. are the actual holder of the Telegram account used for linking;
  4. will not link third-party devices or Telegram accounts to their Yuppiex account.

The service is not intended for anyone other than registered clients and is not accessible anonymously.

5. Activation and account linking

Linking takes place exclusively through a personal single-use link generated by the user within their account area at app.yuppiex.com.

  1. The link is valid for a limited time and can be used only once.
  2. Generating a new link invalidates the previous one.
  3. The link is personal: sharing it, whether intentionally or accidentally, allows third parties to receive information about the user's account. The user is responsible for safeguarding it, as they are for their credentials under Section 5 of the general Terms and Conditions.
  4. The user may link a limited number of devices, as indicated at the time of linking.

Activating the Bot is voluntary and optional: not activating it does not limit in any way access to the platform or to the subscribed services.

6. Content of notifications

The Bot may send notifications about the following events, all relating only to the recipient's own account:

  • outcome of simulations and challenges (qualification or non-qualification);
  • approaching expiry of the subscription or membership;
  • processed withdrawals;
  • credits of commissions and other amounts in favour of the user;
  • technical communications about the operation of the Bot itself.

The Bot does not show or send: personal or financial data of other users, information about the referral network or structure, rankings, login credentials, passwords of accounts held with third parties, documents or payment details.

The user may disable individual notification categories or the entire service at any time through the commands provided by the Bot.

7. Informational value of notifications

Notifications sent by the Bot are for information and courtesy purposes only.

  1. The account area prevails. In the event of a discrepancy between the content of a notification and what appears in the user's account area or in the Company's systems, the latter prevails.
  2. Delivery is not guaranteed. Delivery depends on Telegram, on connectivity and on the user's device. The Company does not guarantee that notifications will be delivered, delivered in time or viewed.
  3. No exonerating effect. Failure to receive a notification, or receiving it late or incorrectly, does not justify non-compliance with deadlines, obligations or contractual conditions, nor does it give rise to any right to compensation. It is the user's responsibility to check their position in the account area.
  4. Notifications do not constitute formal contractual communication and do not replace communications sent to the other contact details provided by the user.

8. Personal data

Personal data processing connected with the Bot is carried out in accordance with the YuppieX Privacy Policy and applicable law, including Regulation (EU) 2016/679 (GDPR) where applicable and UAE Federal Decree Law No. 45 of 2021 (PDPL) where applicable.

Data processed in relation to the Bot

Telegram chat identifier, Telegram username where available, preferred language, linking date and status, notification preferences, technical delivery log (event type and outcome).

Purposes

Provision of the notification service requested by the user, service security, abuse prevention.

Legal basis

The user's consent, given through the voluntary activation of the link and revocable at any time without consequences for the other services; and the Company's legitimate interest in the security of the service.

Disclosure to third parties

Sending notifications necessarily involves the transit of their content through the infrastructure of Telegram, a third party independent of the Company, with its own terms and privacy notices, which the user is invited to consult. The Company does not control the storage and processing practices adopted by Telegram.

International transfers

Data may be processed in countries other than the user's, including the United Arab Emirates and countries of the European Union, as provided in the Privacy Policy.

Retention

Linking data is retained for as long as the link remains active and, thereafter, for the time necessary for legal, security and abuse-prevention purposes. Unlinking stops all sending and results in the deletion or anonymisation of linking data no longer needed.

User rights

Access, rectification, erasure, restriction, objection, portability and withdrawal of consent, exercisable by writing to info@yuppiex.com.

Notice. Notifications contain information about the user's own account and are displayed on the user's device, including as a lock-screen preview. Users are invited to consider this and to protect their device and Telegram account appropriately.

9. Security and anti-fraud notice

The Bot never asks for: passwords, access codes, two-factor codes, payment card details, money transfers or the installation of software.

Any message requesting such items, even if apparently from YuppieX or from a profile imitating its name and image, does not come from the Company and must be reported to support@yuppiex.com without acting on it.

The Company is not liable for the consequences of communications with unofficial Telegram bots, channels, groups or profiles.

The user must promptly inform the Company of any loss of control over their Telegram account or linked device, so that the link can be revoked.

10. Permitted use and prohibitions

It is forbidden to:

  • use the Bot for unlawful purposes or in breach of applicable law;
  • attempt to access data relating to other users;
  • circumvent, probe or compromise the service's linking, authentication or rate-limiting mechanisms;
  • automate, replicate, resell or redistribute the service or its content;
  • present the Bot, or the content it conveys, as a financial service, trading signal or advice;
  • use the Bot's trademarks, logos, name or graphics to create channels, groups or bots that could be confused with the official ones.

The Company may immediately suspend or revoke the link in the event of breach, suspected abuse or security risk, pursuant to Section 16 of the general Terms and Conditions.

11. Service availability

The Bot is provided "as is", without warranties of continuity, availability or absence of errors. The Company may, at any time and without notice, modify, suspend or discontinue the service, in whole or in part, including for technical, security or regulatory reasons, without this giving rise to any right to compensation.

The operation of the Bot depends on Telegram: interruptions, limitations, blocks or changes introduced by Telegram, or the unavailability of the service in the user's country, are not attributable to the Company.

12. Limitation of liability

To the extent permitted by applicable law, and consistently with Section 12 of the general Terms and Conditions, YUPPIES FZCO is not liable for:

  • failed, late, duplicated or incorrect receipt of notifications;
  • decisions taken by the user on the basis of the content of a notification;
  • unauthorised access to the user's device or Telegram account;
  • sharing, whether intentional or accidental, of the personal linking link;
  • malfunctions, interruptions or restrictions attributable to Telegram or other third parties;
  • loss of data or messages caused by factors beyond the Company's control.

As this is an ancillary and free service, no liability of the Company can arise from the mere failure of the Bot to operate, without prejudice to the mandatory rights granted to consumers by applicable law.

13. Deactivation

The user may stop the service at any time:

  • with the /stop command within the Bot;
  • from the dedicated section of their account area;
  • by blocking the Bot on Telegram.

Deactivation takes immediate effect on new sendings, entails withdrawal of the consent referred to in Section 8 and has no effect on the Yuppiex account, the subscription or the other subscribed services.

14. Changes to these Terms

The Company may amend these Terms at any time. Amendments take effect upon publication on yuppiex.com. Material changes will be announced through the Bot itself or the other contact channels. Continued use of the Bot after publication constitutes acceptance of the amendments; otherwise, the user may deactivate the service under Section 13.

15. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws applicable in the United Arab Emirates, without prejudice to the mandatory rights granted to consumer users by the law of their country of residence.

Any dispute arising from or connected with these Terms or the use of the Bot shall be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, unless otherwise mandatorily provided by law.

The user declares that they expressly approve the following clauses: Section 7 (Informational value of notifications), Section 11 (Service availability), Section 12 (Limitation of liability), Section 15 (Governing law and jurisdiction).

El Bot forma parte integrante de los servicios de la plataforma Yuppiex y complementa, sin sustituirlos, el área privada y los demás canales de comunicación oficiales.

2. Objeto y naturaleza del servicio

El Bot es un servicio accesorio y gratuito de notificación, reservado a los usuarios registrados en la plataforma Yuppiex, que envía al canal de Telegram del usuario información relativa exclusivamente a su propia cuenta.

El Bot:

  • no presta servicios financieros, de inversión ni de intermediación;
  • no ofrece asesoramiento financiero, fiscal ni legal;
  • no ejecuta órdenes, operaciones, pagos, retiros ni modificaciones de ningún tipo;
  • no gestiona fondos, capitales ni instrumentos financieros;
  • no constituye recomendación, señal operativa, solicitud ni promesa de resultado.

En coherencia con la naturaleza de la plataforma Yuppiex descrita en la Sección 2 de los Términos y Condiciones generales, toda la información transmitida por el Bot tiene finalidad exclusivamente informativa, educativa, técnica o simulativa. En particular, las referencias a challenges, simulaciones, fases y resultados se refieren a entornos simulados y no a rendimientos en mercados regulados.

3. Relación con los demás documentos contractuales

El uso del Bot implica la aceptación íntegra de los presentes Términos y, en lo no expresamente exceptuado, de los siguientes documentos, que siguen siendo plenamente aplicables:

En caso de conflicto entre los presentes Términos y los Términos y Condiciones generales, prevalecerán estos últimos, salvo que los presentes Términos regulen de forma más específica el funcionamiento del Bot.

El uso del Bot está además sujeto a los términos de servicio y las políticas de Telegram, aplicación de mensajería gestionada por terceros ajenos a YUPPIES FZCO.

4. Requisitos y admisibilidad

Para utilizar el Bot, el usuario declara y garantiza:

  1. ser titular de una cuenta activa y debidamente registrada en la plataforma Yuppiex;
  2. tener al menos 18 años y la capacidad jurídica necesaria;
  3. ser el titular efectivo de la cuenta de Telegram utilizada para la vinculación;
  4. no vincular a su cuenta Yuppiex dispositivos o cuentas de Telegram de terceros.

El servicio no está destinado a personas distintas de los clientes registrados y no es accesible de forma anónima.

5. Activación y vinculación de la cuenta

La vinculación se realiza exclusivamente mediante un enlace personal de un solo uso generado por el usuario dentro de su área privada en app.yuppiex.com.

  1. El enlace tiene validez limitada en el tiempo y puede utilizarse una sola vez.
  2. La generación de un nuevo enlace invalida el anterior.
  3. El enlace es personal: compartirlo, de forma voluntaria o accidental, permite a terceros recibir la información relativa a la cuenta del usuario. El usuario es responsable de su custodia, al igual que de sus credenciales conforme a la Sección 5 de los Términos y Condiciones generales.
  4. El usuario puede vincular un número limitado de dispositivos, indicado en el momento de la vinculación.

La activación del Bot es voluntaria y opcional: no activarlo no limita en modo alguno el acceso a la plataforma ni a los servicios contratados.

6. Contenido de las notificaciones

El Bot puede enviar notificaciones sobre los siguientes eventos, todos referidos únicamente a la cuenta del usuario destinatario:

  • resultado de las simulaciones y de los challenges (calificación o no calificación);
  • proximidad del vencimiento de la suscripción o membresía;
  • retiros procesados;
  • abonos de comisiones y otros importes a favor del usuario;
  • comunicaciones técnicas relativas al funcionamiento del propio Bot.

El Bot no muestra ni envía: datos personales o económicos de otros usuarios, información sobre la red de referidos o la estructura, clasificaciones, credenciales de acceso, contraseñas de cuentas en terceros, documentos ni datos de pago.

El usuario puede desactivar categorías individuales de notificación o el servicio completo en cualquier momento mediante los comandos que ofrece el Bot.

7. Valor informativo de las notificaciones

Las notificaciones enviadas por el Bot tienen valor exclusivamente informativo y de cortesía.

  1. Prevalece el área privada. En caso de discrepancia entre el contenido de una notificación y lo que consta en el área privada del usuario o en los sistemas de la Sociedad, prevalecerá esto último.
  2. La entrega no está garantizada. La recepción depende de Telegram, de la conectividad y del dispositivo del usuario. La Sociedad no garantiza que las notificaciones se entreguen, se entreguen a tiempo ni se visualicen.
  3. Sin efecto liberatorio. La falta de recepción, la recepción tardía o errónea de una notificación no justifica el incumplimiento de plazos, obligaciones o condiciones contractuales, ni genera derecho alguno a indemnización. Es responsabilidad del usuario verificar su situación en el área privada.
  4. Las notificaciones no constituyen comunicación contractual formal ni sustituyen las comunicaciones enviadas a los demás datos de contacto indicados por el usuario.

8. Datos personales

El tratamiento de datos personales relacionado con el Bot se realiza conforme a la Política de Privacidad de YuppieX y a la normativa aplicable, incluido el Reglamento (UE) 2016/679 (RGPD) cuando sea aplicable y el UAE Federal Decree Law No. 45 of 2021 (PDPL) cuando sea aplicable.

Datos tratados en relación con el Bot

Identificador del chat de Telegram, nombre de usuario de Telegram si está disponible, idioma preferido, fecha y estado de la vinculación, preferencias de notificación, registro técnico de envíos (tipo de evento y resultado).

Finalidades

Prestación del servicio de notificación solicitado por el usuario, seguridad del servicio, prevención de abusos.

Base jurídica

Consentimiento del usuario, manifestado con la activación voluntaria de la vinculación y revocable en cualquier momento sin consecuencias para los demás servicios; así como el interés legítimo de la Sociedad en la seguridad del servicio.

Comunicación a terceros

El envío de las notificaciones implica necesariamente el tránsito de su contenido a través de la infraestructura de Telegram, tercero independiente de la Sociedad, con sus propias condiciones y avisos de privacidad, que el usuario está invitado a consultar. La Sociedad no controla las modalidades de conservación y tratamiento adoptadas por Telegram.

Transferencias internacionales

Los datos pueden tratarse en países distintos del país del usuario, incluidos los Emiratos Árabes Unidos y países de la Unión Europea, según lo previsto en la Política de Privacidad.

Conservación

Los datos relativos a la vinculación se conservan mientras la vinculación permanezca activa y, posteriormente, durante el tiempo necesario para el cumplimiento de obligaciones legales, de seguridad y de prevención de abusos. La desvinculación implica el cese de los envíos y la eliminación o anonimización de los datos de vinculación que ya no sean necesarios.

Derechos del usuario

Acceso, rectificación, supresión, limitación, oposición, portabilidad y revocación del consentimiento, ejercitables escribiendo a info@yuppiex.com.

Advertencia. Las notificaciones contienen información relativa a la propia cuenta y se muestran en el dispositivo del usuario, incluso como vista previa en la pantalla de bloqueo. Se invita al usuario a tener en cuenta esta circunstancia y a proteger adecuadamente su dispositivo y su cuenta de Telegram.

9. Seguridad y advertencia antifraude

El Bot nunca solicita: contraseñas, códigos de acceso, códigos de doble factor, datos de tarjetas de pago, transferencias de dinero ni la instalación de software.

Cualquier mensaje que solicite tales elementos, aunque aparente proceder de YuppieX o de un perfil que imite su nombre e imagen, no procede de la Sociedad y debe comunicarse a support@yuppiex.com sin atenderlo.

La Sociedad no responde de las consecuencias derivadas de comunicaciones mantenidas con bots, canales, grupos o perfiles de Telegram no oficiales.

El usuario debe comunicar sin demora a la Sociedad la pérdida de control de su cuenta de Telegram o del dispositivo vinculado, para que la vinculación pueda revocarse.

10. Uso permitido y prohibiciones

Queda prohibido:

  • utilizar el Bot con fines ilícitos o en infracción de la normativa aplicable;
  • intentar acceder a datos relativos a otros usuarios;
  • eludir, sondear o comprometer los mecanismos de vinculación, autenticación o limitación del servicio;
  • automatizar, replicar, revender o redistribuir el servicio o sus contenidos;
  • presentar el Bot, o los contenidos que transmite, como servicio financiero, señal operativa o asesoramiento;
  • utilizar marcas, logotipos, nombre o gráficos del Bot para crear canales, grupos o bots que puedan confundirse con los oficiales.

La Sociedad puede suspender o revocar de inmediato la vinculación en caso de infracción, sospecha de abuso o riesgo para la seguridad, conforme a la Sección 16 de los Términos y Condiciones generales.

11. Disponibilidad del servicio

El Bot se presta "tal cual", sin garantías de continuidad, disponibilidad o ausencia de errores. La Sociedad puede, en cualquier momento y sin previo aviso, modificar, suspender o cesar el servicio, total o parcialmente, incluso por necesidades técnicas, de seguridad o de cumplimiento normativo, sin que ello dé derecho a indemnización.

El funcionamiento del Bot depende de Telegram: las interrupciones, limitaciones, bloqueos o cambios introducidos por Telegram, o la indisponibilidad del servicio en el país del usuario, no son imputables a la Sociedad.

12. Limitación de responsabilidad

En la medida permitida por la ley aplicable, y en coherencia con la Sección 12 de los Términos y Condiciones generales, YUPPIES FZCO no responde de:

  • la falta de recepción, la recepción tardía, duplicada o errónea de las notificaciones;
  • las decisiones adoptadas por el usuario sobre la base del contenido de una notificación;
  • los accesos no autorizados al dispositivo o a la cuenta de Telegram del usuario;
  • la compartición, voluntaria o accidental, del enlace personal de vinculación;
  • los fallos, interrupciones o restricciones imputables a Telegram o a otros terceros;
  • la pérdida de datos o mensajes causada por factores ajenos al control de la Sociedad.

Al tratarse de un servicio accesorio y gratuito, ninguna responsabilidad de la Sociedad puede derivarse del mero fallo de funcionamiento del Bot, sin perjuicio de los derechos irrenunciables reconocidos al usuario consumidor por la normativa aplicable.

13. Desactivación

El usuario puede interrumpir el servicio en cualquier momento:

  • con el comando /stop dentro del Bot;
  • desde la sección correspondiente de su área privada;
  • bloqueando el Bot en Telegram.

La desactivación surte efecto inmediato sobre los nuevos envíos, implica la revocación del consentimiento previsto en la Sección 8 y no produce efecto alguno sobre la cuenta Yuppiex, la suscripción ni los demás servicios contratados.

14. Modificaciones de los presentes Términos

La Sociedad puede modificar los presentes Términos en cualquier momento. Las modificaciones entran en vigor desde su publicación en yuppiex.com. Las modificaciones sustanciales se comunicarán a través del propio Bot o de los demás canales de contacto. El uso continuado del Bot tras la publicación constituye aceptación de las modificaciones; en caso contrario, el usuario puede desactivar el servicio conforme a la Sección 13.

15. Ley aplicable y jurisdicción

Los presentes Términos se rigen e interpretan de conformidad con las leyes aplicables en los Emiratos Árabes Unidos, sin perjuicio de los derechos irrenunciables reconocidos a los usuarios consumidores por la normativa de su país de residencia.

Cualquier controversia derivada de o relacionada con los presentes Términos o con el uso del Bot se someterá a la competencia exclusiva de los tribunales de Dubái, Emiratos Árabes Unidos, salvo disposición legal imperativa en contrario.

16. Cláusulas específicamente aprobadas

El usuario declara aprobar expresamente las siguientes cláusulas: Sección 7 (Valor informativo de las notificaciones), Sección 11 (Disponibilidad del servicio), Sección 12 (Limitación de responsabilidad), Sección 15 (Ley aplicable y jurisdicción).
